Government and law enforcement data requests

1. Who this covers

This policy explains how Prochar (“we”), the operator of Prochar, handles requests from public authorities — police, regulators, courts or government agencies — for personal data about the people who use Prochar, including data received from Meta through the Facebook and Instagram APIs.

2. We check that the request is lawful

  • Every request must be in writing, on the authority's own letterhead or official channel, and must name the legal power it is made under.
  • We check that the authority has jurisdiction over us and that the request is valid under the law of Bangladesh.
  • An informal request — a phone call, a message, a verbal instruction — is not acted on.

3. We challenge requests that are not lawful

If a request appears unlawful, overbroad, or made without proper authority, we object to it in writing and, where necessary, seek legal advice and challenge it before disclosing anything. We do not disclose data while a challenge is pending unless the law requires us to.

4. We disclose the minimum necessary

  • We disclose only the specific data described in the request, for the named person and period — never a whole database or an entire account export when a narrower answer will do.
  • Passwords are never disclosed (we cannot read them), and access tokens for connected social accounts are not disclosed.

5. We keep a record

Every request is recorded with the date, the authority, the legal basis given, what we disclosed or refused, the reasoning, and who decided. The record is kept for at least five years.

6. We tell the person, where we can

Unless a court order or the law forbids it, we notify the affected user before disclosing their data so that they have a chance to object.

7. National security requests

We have not disclosed personal data to any public authority in response to a national security request. If that ever changes, this page is updated.
